NovaBounty Terms of Service

Welcome to NovaBounty ("we," "our," "us"). These Terms of Service ("Terms") govern your access to and use of the NovaBounty platform, applications, and services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. Please read them carefully.

1. Eligibility

• Creators must be at least 18 years old and legally able to participate in campaigns.
• Companies must be legally incorporated or authorized entities capable of entering into binding agreements.
• By using the Service, you represent and warrant that you meet these requirements.

2. How the Service Works

For Companies:

• Companies link a valid payment card, set a campaign limit (hard cap), and define bounty payouts.
• Companies are charged only when submissions are approved after verification.

For Creators:

• Creators can join campaigns without prior approval.
• Submissions are reviewed using AI + human review.
• If approved, payouts are released to creators' linked accounts (minus fees).

For NovaBounty:

• We facilitate the connection, verification, and payouts.
• We do not guarantee campaign outcomes, specific reach, or earnings.

3. Fees and Payments

• Companies agree to fund campaigns via card-on-file and honor approved payouts.
• NovaBounty may charge platform service fees, disclosed before campaign launch.
• Creators may incur withdrawal or processing fees when transferring earnings.
• All fees are subject to change with notice.

4. Creator Obligations

Creators agree to:

• Submit original, authentic content in compliance with campaign requirements.
• Avoid fraudulent behavior such as fake views, bots, or policy violations.
• Respect brand guidelines, required hashtags, and platform policies.
• Understand that rejected submissions will not receive payouts.

5. Company Obligations

Companies agree to:

• Provide accurate campaign details, rules, and requirements.
• Maintain sufficient funds via the linked payment card.
• Accept that approved claims cannot be retroactively disputed or withheld once verified.

6. Platform Rights

• NovaBounty may suspend or terminate accounts for fraud, abuse, or violation of these Terms.
• We may modify, suspend, or discontinue parts of the Service with reasonable notice.
• We may refuse payouts if submissions violate laws, platform policies, or campaign rules.

7. Intellectual Property

• Companies retain rights to their brand materials provided for campaigns.
• Creators retain ownership of their content but grant companies a limited license for promotional use if explicitly stated in campaign rules.
• NovaBounty retains rights to its platform, technology, and trademarks.

8. Limitation of Liability

• NovaBounty is not liable for indirect, incidental, or consequential damages.
• Our total liability under these Terms will not exceed the total amount paid or earned through the platform in the twelve (12) months prior to the claim.

9. Dispute Resolution

• Any dispute shall first be attempted to resolve informally through NovaBounty support.
• If unresolved, disputes will be submitted to binding arbitration.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes will be resolved exclusively in the state or federal courts located in Delaware.

11. Changes to the Terms

We may update these Terms periodically. Continued use of the Service after updates means you accept the revised Terms. The "Effective Date" above shows the most recent update.
